REQUIREMENTS OF THE SOUTHWESTERN LOW-LEVEL RADIOACTIVE WASTE COMMISSION FOR EXPORTATION PETITIONS FOR LOW-LEVEL RADIOACTIVE WASTE DISPOSAL

Section A. Terms and Conditions
- The petitioner is to use the name and code, as assigned, on all manifests.
- The low-level radioactive waste to be exported is to be as defined in Public Law 99-240 or Public Law 100-712.
- A description is to be included of the estimated disposal volume and characterization of the low-level radioactive waste to be exported.
- The receiving disposal facility is to be identified.
- The proposed broker is to be identified.
- The low-level radioactive waste to be exported is to be in accordance with any rules or regulations of the receiving compact and regulatory agency.
- Authority to export is to end December 31, 2025 or the date operations begin at the Southwestern Compact’s regional disposal facility, whichever is earlier.
- Petitioner understands the Commission has no authority over or any responsibility for environmental or regulatory aspects of the disposal facility.
- The petitioner is to be under no obligation to use the receiving disposal facility and is to do so at the petitioner’s own risk as an option of choice.
- The petitioner is to submit to the Commission by June 30, 2026 a report of the type, volume and radioactivity of all disposals under the petition. If a petition covers more than one year, the report is to include all disposals during 2025. Petitioner is to understand that failure to submit such report is grounds for withdrawal of approval granted and denial of future petitions.
- The petitioner is to pay a specified fee to the Commission.
Section B. Authority and Discretion of the Executive Director
- The Executive Director is authorized to process petitions on behalf of the Commission for exportation to a licensed low-level radioactive waste disposal facility, provided that the petitions are consistent with the criteria in Section A above. Such petitions which are consistent with the criteria in Section A are deemed approved by the Commission.
- The Executive Director is authorized to request clarifying information from the petitioner prior to approving any petition.
- The Executive Director is granted discretion to refer any petition to the Commission for approval.
- The Executive Director is authorized to withdraw approval of a currently approved petition if the petitioner fails to comply with a term or condition of approval. Such withdrawal shall be communicated to the specified disposal facility.
